Mascot Airport Valet Parking Terms and Conditions of Service
1. Introduction
1.1. These are the Terms upon which we accept internet Bookings on this website.1.2. Before your booking is accepted by us you will be prompted to acknowledge that you have read, understand and accept these terms and conditions, it is important that you read and understand these Terms before making your Booking.
1.3. If there is anything you do not understand in these Terms or do not agree with, please do not proceed with your Booking. You may contact us at info@mascotvalet.com.au with questions.
1.4. Some legal obligations imposed by law cannot be limited or excluded. No attempt to limit or exclude such liability is made by us.
1.5. We only accept Bookings for cars, light utility vehicles and light vans. Please contact us at info@mascotvaletparking.com.au if you wish to check whether your Vehicle is acceptable.
2. Definitions & Interpretation
‘Customer, ‘You, Your; means the person named as such on the booking form, either the owner of the Vehicle, or authorised by the owner of the Vehicle as agent of the owner, to use the Valet Parking Services.‘Fees; means fees set by Mascot Airport Valet Parking and/or for the Valet Parking Services.
‘ Us, We; means; Mascot Airport Valet Parking (ABN 86 06 635 521 513) and includes, where the context permits, Mascot Airport Valet Parking employees.
‘Terms and Conditions; means the terms and conditions set out in this document as varied from time to time at the sole discretion of Mascot Airport Valet Parking .
‘Valet Car Park Area; means any place or places nominated by us where the Valet Parking Services are performed from time to time and includes the indoor and outdoor parking area and the pick-up and drop-off points specified by us.
‘Valet Parking Services; means the services offered by the us to the Customer, including the moving and parking of the Vehicle, cleaning or washing services and any other services rendered in respect of the Vehicle.
3. Customer‘s Obligations
3.1. You acknowledge that it is your responsibility to meet your airline‘s check-in time and to allow sufficient time for unexpected delays, traffic congestion, accident/s, road works, delays at or near Sydney Domestic and International Airports or in operation of shuttle services between the Car Park and the terminal.3.2. The Vehicle and any articles or personal belongings inside it remain always at the Customer‘s own risk.
3.3. The Customer must pay all applicable Fees prior to the collection of the Vehicle. The schedule of Fees is available from the Valet desk and may change from time to time at the sole discretion of us.
3.4. If Mascot Airport Valet Parking’s performance of its obligations under these Terms and Conditions is prevented or delayed by any act or omission of the Customer, Mascot Airport Valet Parking is not liable for any costs, charges, damages or losses incurred by the Customer arising directly or indirectly from such prevention or delay.
3.5. The Vehicle is in good and road worthy condition and capable of being driven safely;
3.6. The Vehicle is duly licensed; and
3.7. There are no matters which we or our staff should be aware of in respect of the Vehicle to enable the Parking Services to be performed without causing or being likely to cause damage or injury to us or our staff or any other person or thing.
4. Free Shuttle Bus Service
4.1. No guarantee is given as to the time taken, availability or frequency of such transport between our premises and the Sydney International and domestic terminals.4.2. A shuttle bus driver may prevent access to and or remove any passenger or luggage item from a shuttle bus. Passengers numbers are limited to seating capacity. No standing is permitted in the shuttle bus. Carriage of luggage may be limited. Any damage to a shuttle bus or any luggage or equipment intended to be or carried therein that is caused in any manner whatsoever including whether by a customer or person travelling with them, will be the customer‘s responsibility.
5. Refund and cancellation policy
5.1 Were parking has been purchased at a discounted price during any promotional period (10% and 20% off parking) refunds will not be offered. However a full credit of the parking cost will be updated to your booking, that you can use within a 2 years period. 24 hours cancellation policy applies. If you do not cancel within the 24 hour period, no credit will be added to your booking.
5.2 Where you are entitled to a refund, that refund will be paid electronically into the bank/credit account that you used to pay for your booking, less any fees as described and may take between 3 – 14 business days.
5.3 All Cancellations will incur a $20 non refundable processing fee including but not limited to, credit card fees and any other fees notified to you as non refundable.
5.4 Refunds and cancellations of bookings are only effective where:
5.5 You notify us by email to admin@mascotvaletparking 24 hours or prior to the start of your booking period. Your email must set out your full name, contact number, and booking invoice number.
5.6 You paid for your booking using your own credit card
5.7 You effectively cancel a booking 24 hours or more prior to your booking period.
You are not entitled to a refund from Mascot Valet Parking if you:
5.8 Do not use the whole part of the nominated period that you booked, including valet services.
5.9 You have purchased parking from any other business or organization that is not Mascot Valet Parking.
5.10 You fail to cancel a booking 24 hours or more prior to the start of the booking period.
5.11 You purchase your airport parking whilst a promotion is being run eg 10 off or 20% parking rates purchased online.
6. Liability
6.1. We warrant that any services provided by us will be rendered with due care and skill. We make no other express warranties in relation to the services we provide. All other warranties, representations and conditions relating to the services (whether express or implied and whether arising in contract, at common law or under statute) are to the maximum extent permitted by law expressly excluded.6.2. We will not be liable to you for damage to the Vehicle for any service performed in respect of;
pre-existing damage whatsoever including;
- windscreen adhered accessories (E-tags, sat-navigation aids, mirrors etc.);
- valuables left in Vehicle;
- cracked or chipped windows including tints;
- oxidised, chipped, blistered or flakes paintwork
- modified or altered Vehicles including wheels or poorly fitted aftermarket accessories including but not limited to number plate frames;
- automatic door locks, kill switches or alarms;
- cracked or faulty bonnet, windshield, headlight protectors, loose mudflaps, side skirts or bumpers;
- antennas and roof racks;
- faulty ignition, batteries, alarm keys or mechanical faults;
- vehicle graphics.
6.3. We will only be liable to you under these Terms if:
6.4. Loss or damage is proven to be caused by the negligence, willful act, default or breach of statutory duty by us, our employees, servants or agents.
However, under no circumstances are we liable to you for any lost profits, lost opportunity, loss of reputation or any indirect or consequential loss. In addition, we will not be liable to you for any part of any cost, expense, loss or damage suffered by you which is caused:
- by your acts or omissions or the acts or omissions of other users of the Valet Car Park or
- otherwise in excess of what an ordinary person in a like situation would suffer, or which is caused by circumstances unique to your situation.
6.5. The Customer is liable for any destruction, loss or damage caused by the Customer‘s Vehicle to other persons or property, including Mascot Airport Valet Parking’S property.
6.6. To the fullest extent permitted by law, we shall not be liable whether in negligence or any other tort or in contract or on any other basis whatsoever for and the Customer hereby releases Mascot Airport Valet Parking from:
- any loss or destruction of, or diminution of value or damage to, the Vehicle or any articles or personal belongings inside the Vehicle; or
- any delay in transporting the Customer, the Vehicle and/or other passengers accompanying the Customer between any part of the Airport (including any terminal) and any Valet Car Park Area;
6.7. You acknowledge that our liability under any statutory right, or any condition or warranty implied by the Competition and Consumer Act 2010 (Cth) which cannot be excluded, is to the extent permitted by law limited (at our option) to:
- supplying the Valet Parking Services again; or
- payment of the cost of supplying the Valet Parking Services.
6.8. While Mascot Airport Valet Parking and its employees shall take all reasonable care to keep the Valet Car Park Area safe, the Customer acknowledges that Mascot Airport Valet Parking and its employees cannot guarantee the security of the Vehicle while at the Valet Car Park Area.
6.9.Mascot Airport Valet Parking and its employees accepts no liability for any loss or damage to any article or personal belongings left in our custody or control. Mascot Airport Valet Parking and its employees are not authorised to accept any personal belongings for safe custody, except the keys to the Vehicle.
6.10.We shall have no liability to the Customer if it is prevented from, or delayed in performing, the Valet Parking Services by acts, events, omissions or accidents beyond its reasonable control, including industrial disputes (whether involving the workforce of Mascot Airport Valet Parking or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.
7. Warranty and Indemnity
7.1. The Customer warrants that the Customer is either the owner of the Vehicle, or authorised by the owner of the Vehicle as agent of the owner, to use the Valet Parking Services.7.2. If the Customer uses the Valet Parking Services as an agent of the owner of the Vehicle, by agreeing to these Terms and Conditions, the Customer accepts that these Terms and Conditions apply to the Customer as well as to the owner of the Vehicle.
7.3. The Customer warrants that the Vehicle is registered.
7.4. Without limiting the generality of clauses 7.1 and 7.2, the Customer warrants and agrees that the Customer and the Vehicle owner (if the Customer is not the owner) releases and indemnifies us, representatives, employees, directors, and officers of Mascot Airport Valet Parking against all and any actions, suits, proceedings, demands, liabilities, claims, damages, losses, charges, costs and expenses arising out of or in any way connected with the provision of the Valet Parking Services in respect of the Vehicle whether arising under statute, Common Law or otherwise.
8. Authority in Respect of the Vehicle
8.1. The Customer authorises us to perform any act that we deem to be necessary for it to supply the Valet Parking Services, including the following:
- Entering the Vehicle.
- Driving the Vehicle within the Valet Car Park Area or to any location outside the Valet Car Park Area to enable us to supply the Valet Parking Services. The Vehicle may be shifted between locations in the Valet Car Park Area during the time the Valet Parking Services are performed.
- Adjusting the driver seat position/mirror position for any purpose that is deemed necessary to transport the Vehicle safely and/or complete any cleaning or washing services as agreed between the Customer and us correctly.
- To ‘jump-start‘ or use any other method and/or do all other things reasonably necessary to start, move or relocate the Vehicle for any purpose. Notwithstanding this clause 9(iv), the Customer acknowledges that if the Vehicle is inoperative and remains in an inoperative state at the time of return, we are not responsible to re- start the Vehicle.
9. Authority to Release Vehicle
9.1. The Customer authorises us to grant access to the Vehicle or release the Vehicle to any person who produces satisfactory verification that the person is the owner or has authority or is entitled to possession of the Vehicle.9.2. The Customer releases and agrees not to hold us liable for providing access to or delivering the Vehicle to any person in accordance with clause 9.1.
10. Unpaid Fees and Abandonment
10.1. The Customer agrees that Mascot Airport Valet Parking and its employees shall not be obliged to release the Vehicle until all Fees due and unpaid in respect of the Vehicle under these Terms and Conditions are paid.10.2. If the Vehicle has not been collected within 30 days of the return date nominated on the booking form, then Mascot Airport Valet Parking may, after making reasonable attempts to contact the Customer, sell the Vehicle and/or the goods in the Vehicle by auction or otherwise at the sole discretion of Mascot Airport Valet Parking.
11. Governing Law and Invalidity
11.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales. The Customer agrees to submit to the exclusive jurisdiction of the New South Wales Courts.11.2. If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severed from these Terms and Conditions and shall not affect the validity and enforceable of the remaining provisions.
12. Personal Information
12.1. When the Customer provides personal information to Mascot Airport Valet Parking and its employees in connection with the Valet Parking Services, the Customer is deemed to have consented to the collection, storage, disclosure and use of such personal information by us in the manner described in these Terms and Conditions.12.2. The collection, storage, disclosure and use of personal information is subject to applicable laws including the Privacy Act 1988 (Cth). The Customer has the right to access their personal information recorded by us and have it updated or corrected as necessary.

15.1. The Conditions of Entry shall form part of these Terms and Conditions. To the extent of any inconsistency between the Conditions of Entry and these Terms and Conditions, these Terms and Conditions shall prevail.
